General Conditions of Sale

 

ARTICLE 1 - SCOPE OF APPLICATION

These general conditions of sale apply to all orders placed under the MAISON TESS TRAITEUR brand, unless otherwise agreed in writing prior to the sale in a contract between MAISON TESS TRAITEUR and the CLIENT. 

 

Their purpose is to govern the contractual relations between SARL LES SOURCES TRAITEUR, whose head office is located at 33 Rue des acacias, 75017 Paris and registered in the commercial register under number 828 753 137, and the CLIENT, who accepts without reserves, by the sole fact of placing an order, these general conditions of sale. 

LES SOURCES TRAITEUR reserves the right to modify these general conditions of sale at any time. The applicable conditions will be those in force at the time of validation of the order by the CUSTOMER. 

 

ARTICLE 2 - QUOTE & ORDER

A quote is systematically given to the CUSTOMER in order to determine their needs. This sales document precisely determines its entire service. In order to confirm his order, the CUSTOMER will return his quote with the mention “good for agreement”, will affix his signature, the date of its receipt in handwriting and, if applicable, his commercial stamp. 

 

In addition, in order to allow the registration of your order:

• For a company, it must attach a deposit payment of 50% of the amount including tax of the forecast estimate. 

• For an individual, he must attach a payment of 50% of the order, the balance will be paid at the latest on the day of delivery.

• For weddings, a deposit check of 50% of the amount including tax of the estimated estimate will be requested upon signing the estimate, the balance must be paid 10 days before the date of the event.

 

In the event of an order cancellation, the following compensation is applied:

 

In case of cancellation for a wedding:

• Up to 10 months before the date of the event, the deposit amount will be refunded in full. 

•  From 10 to 3 months before the date of the event MAISON TESS TRAITEUR reserves the right to request a penalty of 30% of the amount of the initial quote.

• From 3 months to 1 month before the date of the event MAISON TESS TRAITEUR reserves the right to request a penalty of 45% of the amount of the initial quote.

• From 1 month to 8 days before the date of the event MAISON TESS TRAITEUR reserves the right to request a penalty of 80% of the amount of the initial quote.

 

 

In case of cancellation for companies:

• 8 days before the event, the CUSTOMER must pay 50% of the quote.

• 48 hours before the event the CUSTOMER must pay 90% of the quote.

 

In the event of cancellation for an individual:

• 8 days before the event, the CUSTOMER must pay 50% of the quote.

• 48 hours before the event the CUSTOMER must pay 90% of the quote.

 

The CUSTOMER must communicate on this same occasion all the information necessary for his identification and in particular his company name, his telephone number, postal and electronic address and billing and delivery address. 

The customer must check the completeness and conformity of the information concerning the delivery address that he provides. 

MAISON TESS TRAITEUR cannot be held responsible for possible errors and the resulting consequences on the delivery process (errors/delays in particular). 

 

An order thus processed but unable to be delivered, or delivered late, due to insufficient or incomplete information will remain entirely the responsibility of the CUSTOMER, without any possible dispute. 

It should be noted that MAISON TESS TRAITEUR reserves the right to refuse any order when its production capacities are saturated, in order to never compromise with its quality standards. In this case, no claim for compensation by the CUSTOMER will be admissible. At the end of any order placed, the CUSTOMER will systematically receive an order form issued by MAISON TESS TRAITEUR. This summarizes all the identification information as well as the content of the command. 

It is the CUSTOMER's duty to check its completeness and conformity and to notify MAISON TESS TRAITEUR in the event of non-receipt or error. 

Any order modification must be made at least seven working days before the date of receipt, by mail or email. 

The final number of guests must be communicated to MAISON TESS TRAITEUR within the same period (10 days for a wedding). This number of guests will serve as the basis for invoicing, even if it turns out on the day of the reception that the number of guests is lower. 

On the other hand, if it turns out that the number of guests is higher and the caterer was not informed of this early enough, he would not be able to provide a satisfactory service; detrimental to the customer, his guests and the image of the company. Thus, as compensation, MAISON TESS TRAITEUR would be forced to take into account the actual number of guests present at the reception when invoicing.

 

ARTICLE 3 - EXTRA HOURS AND SHIPPING COSTS

If the time specified in the quote is exceeded, overtime will be billed:
During the day from 7:00 a.m. to 10:00 p.m.: at the rate of €40 excluding VAT per hour, per server present,
Night rate from 10:00 p.m. to 7:00 a.m.: at the rate of €55 excluding tax per hour, per server present.

Shipping costs will be determined based on the location of the event, the time spent, it will be mentioned on the quote. 

 

ARTICLE 4 - METHOD OF PAYMENT

To pay for their order, the CUSTOMER has three payment solutions: bank check, bank transfer or cash. MAISON TESS TRAITEUR accepts payment of sums due by checks made out to its name in its capacity as a member of a management center approved by the tax administration.

 

ARTICLE 5 - VALIDITY OF THE ORDER AND LEGAL CAPACITY

The CLIENT declares that it has full legal capacity to commit to the terms of the said contract. By validating a quote or order form with his signature, the CUSTOMER accepts these general conditions of sale without reservation. 

 

ARTICLE 6 - PRODUCTS AND AVAILABILITY

The products offered comply with current French legislation and the standards applicable in France. The products presented for sale are accompanied by a detailed description which allows the potential CUSTOMER to know, before taking the final order, the essential characteristics of the products he wishes to purchase (Article L111-1 of the Consumer Code).  

The photographs, illustrations and descriptions present on the website and on all the brand's communication media have only an indicative value, whether it concerns the container (packaging) or the content (ingredients). Any modification made to the product does not engage the responsibility of the company LES SOURCES TRAITEUR which expressly reserves the right to modify the composition of the products offered for sale. 

 

ARTICLE 7 - PRICE OF PRODUCTS

The prices indicated on the quotes are those in force at the time of their preparation. After this period, and in the absence of confirmation from the customer, the prices may be revised, respecting the general price of MAISON TESS TRAITEUR. 

The company LES SOURCES TRAITEUR reserves the right to modify its prices at any time but undertakes to apply the prices in force which will have been indicated at the time of the order, subject to availability on that date. The prices appearing on the various communication media of our brand MAISON TESS TRAITEUR are in Euros including tax and excluding shipping costs. 

 

As a reminder, the VAT rates applied are as follows: 5.5% on non-alcoholic drinks delivered in cans or closed bottles, 10% on food services delivered, and 20% on alcohol and services. Transport costs calculated according to the CUSTOMER's delivery area and the content of their order should be added to this price. In accordance with the practices of our profession, the amount of the estimate and the invoice will include the contribution to the operating costs requested by certain reception venues. This rate varies depending on location.
